Terms of Service — Floatello

1. Scope & Provider

These Terms of Service apply to all orders placed through this online store, operated by ZYNTRAX LLC, 5830 E 2nd St, Ste 7000 #34653, Casper, WY 82609, United States (hereinafter "Floatello", "we", "us"), operating under the brand Floatello.

2. Products & Ordering

All product descriptions, images and prices in our store are presented with care. By clicking "Buy now" / completing checkout, you place a binding order. We confirm receipt of your order by email; the purchase contract is concluded when we dispatch your order or confirm it explicitly.

We reserve the right to decline orders in cases of suspected fraud, pricing errors, or stock unavailability. In such cases, any payment already made will be refunded in full.

3. Prices & Payment

All prices are displayed in the selected store currency and include applicable VAT where required. Shipping is free worldwide. Payment is due at checkout via the payment methods offered (e.g. credit card, PayPal, and other providers shown at checkout).

4. Shipping & Delivery

Orders are dispatched within 24 hours on business days. Estimated delivery time is 6–12 business days. Details are set out in our Shipping Policy, which forms part of these Terms.

5. Right of Withdrawal & 30-Day Guarantee

Consumers in the EU have a statutory 14-day right of withdrawal. In addition, we voluntarily offer a 30-day money-back guarantee on all orders. Details and instructions are set out in our Refund Policy, which forms part of these Terms.

6. Warranty

Statutory warranty rights apply. If a product is defective, you are entitled to the legal remedies (replacement, repair, price reduction or refund) under applicable law. Our 30-day guarantee applies in addition to, and does not limit, your statutory rights.

7. Product Safety & Intended Use

Our products are recreational water products. Please observe the following:

  • Motorized floats are recommended for riders aged 14+ (Kid-size products: for children under adult supervision only).
  • Never exceed the stated maximum rider weight.
  • Products are intended for pools, lakes, rivers and calm coastal waters — not for open sea, strong currents or white water.
  • Children must always be supervised by an adult when in or near water.
  • These products are not life-saving devices and do not replace swimming ability or approved flotation devices.

We accept no liability for damage resulting from improper use, misuse or failure to follow the product instructions.

8. Liability

We are liable without limitation for intent and gross negligence, and for injury to life, body or health. For slight negligence, we are liable only for breaches of essential contractual obligations, limited to the foreseeable damage typical for this type of contract. Statutory liability under mandatory law (e.g. product liability law) remains unaffected.

9. Intellectual Property

All content in this store — including texts, images, videos, logos and designs — is the property of Floatello GmbH or its licensors and may not be used or reproduced without permission.

10. Governing Law

These Terms are governed by the laws of the State of Wyoming, United States. If you are a consumer in the European Union or another jurisdiction with mandatory consumer protection laws, those mandatory provisions of your country of residence remain unaffected.

11. Dispute Resolution

The EU Commission provides a platform for online dispute resolution: https://ec.europa.eu/consumers/odr. We are neither obliged nor willing to participate in dispute resolution proceedings before a consumer arbitration board.

12. Final Provisions

Should individual provisions of these Terms be invalid, the validity of the remaining provisions remains unaffected.
